Please read these terms of service ("Terms") carefully before using [Runners 58] (the "App") operated by [Runners 58 LLC] ("us", "we", or "our").

 

1. Acceptance of Terms

By accessing or using the App in any manner, you agree to be bound by these Terms. If you do not agree with all the terms and conditions of this agreement, then you may not access the App.

 

2. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

 

3. User Accounts

You may be required to create an account to use certain features of the App. You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account or password.

 

4. User Content

You retain ownership of any content you submit, post, or display on or through the App ("User Content"). By submitting, posting, or displaying User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content in any and all media or distribution methods.

 

5. Prohibited Conduct

You agree not to engage in any of the following prohibited activities: (a) use the App for any illegal purpose or in violation of any local, state, national, or international law; (b) violate, or encourage others to violate, any right of a third party; (c) upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

 

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

 

7. Disclaimer of Warranty; Limitation of Liability

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein.

 

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Houston, Texas, USA], without regard to its conflict of law provisions.
